TestTube is a free tool that reads a business idea you type in and returns an automated Opportunity Report — a score out of 100 and a recommendation to pursue, validate, reshape, or skip the idea. It’s operated by Erik Pettee Design, LLC (“we,” “us,” or “Erik Pettee Design”). By using TestTube, you agree to these terms. If you don’t agree, please don’t use it.
01The report is information, not advice
TestTube is for informational and educational purposes only. A report is an automated analysis of the words you submitted — a starting point for your own research. It is not financial, investment, legal, tax, accounting, or business advice, and it isn’t tailored to your specific situation.
Using TestTube does not create any advisor, broker, fiduciary, attorney–client, or other professional relationship between you and us. Before you act on anything in a report, do your own due diligence and talk to qualified professionals who know your circumstances.
02The report is written by AI
Reports are generated by an automated AI system, not a human expert. AI can be confidently wrong. A report may contain facts, figures, market estimates, or conclusions that are inaccurate, incomplete, out of date, or entirely made up, and the same idea may score differently on different runs. Similar ideas may also produce similar reports for other people — your score and recommendation are not unique to you and aren’t a prediction of success or failure.
Treat every report as one automated opinion to pressure-test against your own research — never as the final word. You are responsible for independently verifying anything in a report before relying on it.
03Your decisions are your own
You use TestTube entirely at your own risk. Any decision you make — to start, fund, change, continue, or abandon a business or any other venture — is your own decision, made at your sole discretion. You agree that you are not relying on TestTube’s score or recommendation as the basis for any business, financial, or investment decision, and you accept full responsibility for the outcomes of your decisions, including any financial loss.
04No warranties
We want TestTube to be useful, but we can’t promise it will be. The following is written in capitals because the law asks us to make it impossible to miss:
TestTube and every report are provided “as is” and “as available,” without warranties of any kind. To the maximum extent permitted by law, Erik Pettee Design disclaims all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement, and any warranty that the service or its output will be accurate, complete, reliable, current, secure, or available without interruption.
05Limits on our liability
To the maximum extent permitted by law, Erik Pettee Design and its owners, employees, and providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, lost revenue, lost or wasted investment, lost business opportunities, business interruption, or loss of data, arising out of or relating to your use of TestTube or any report — even if we were advised such damages were possible.
Our total liability for all claims relating to TestTube will not exceed one hundred U.S. dollars (US $100).
Some places don’t allow some of these limits, so parts of this section may not apply to you. In that case, our liability is limited to the smallest amount the law allows.
06Fair use
Please use TestTube the way it’s meant to be used. You agree not to:
- use it for anything unlawful, infringing, harmful, or fraudulent;
- submit content you don’t have the right to share, or other people’s personal or confidential information;
- scrape, crawl, or use bots to access the tool, or run it at a volume that degrades it for others or evades our rate limits;
- reverse engineer, copy, or try to extract the underlying model, prompts, or scoring method; or
- interfere with, overload, or attempt to break the security of the service.
We may rate-limit, suspend, or block access, and may change or discontinue TestTube at any time, without notice.
07Who owns what
You keep your idea. You own the idea text you submit. You give us a limited license to process it — to run it through our AI provider, generate your report, and operate, secure, and improve TestTube.
You may use your report. You’re free to use the report we generate for your own purposes. Because reports are AI-generated, we can’t and don’t promise that yours is unique or exclusively yours — similar reports may be produced for others.
We keep our tool. The TestTube name, software, design, and scoring methodology remain ours.
08Indemnification
You agree to cover us for any claim, loss, or cost (including reasonable legal fees) that arises from your misuse of TestTube, your breach of these terms or any law, the content you submit, or your use of or reliance on a report.
09Governing law
These terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws rules. Any dispute relating to TestTube will be handled in the state or federal courts located in Utah, and you agree to that jurisdiction.
10Changes to these terms
We may update these terms from time to time. When we do, we’ll change the “Last updated” date above, and significant changes will be noted here. Continuing to use TestTube after a change means you accept the updated terms. If any part of these terms is found unenforceable, the rest still applies. Questions? Reach us at EPD.studio.
